Terms Of Service & Conditions

By clicking the "Sign Up" button on the account registration page or by using ZiiP Care to book a Helper, you are agreeing that you have read, understand, and agree to be bound by these Terms of Service & Conditions.

 

If you do not agree or are unable to agree to be bound by these Terms of Service & Conditions, do not use the Site or the Services.

ZiiP Care may modify these Terms of Service & Conditions from time to time. When changes are made, we will make the revised version available on this webpage, and will indicate the date that revisions were last made. Your use of the ZiiP Care after such posting will constitute acceptance by you of such changes.

 

NATURE OF OUR SITE, APP & SERVICES

 

ZiiP Care’s website/App is a Networking Venue for people seeking family help services ("Parents") to connect with people who want to provide those services ("Helpers”). ZiiP Care is not a placement service and does not provide, refer, place, or offer employment to the Helpers.


Though ZiiP Care has no obligation to screen or verify the identity or background of any Helper, we do keep their ID and police background check (if any is provided) on file. 

While ZiiP Care seeks to verify the training and experience of the Helpers and we review Helper profiles for appropriateness, we are not responsible for the content, accuracy, reliability, or completeness of the profiles. Thus, ZiiP Care makes no representations about the Helpers or the Parents. You should make your own assessments of the people you decide to interact with, engage, request  or provide services to.

 

TRANSACTIONS & INTERACTIONS

 

Transactions for Jobs are solely between the Parent and Helper.  ZiiP Care is not an employment service and does not serve as an employer of either Parents or Helpers.  As such, If any disputes or disagreements arise between a Parent and a Helper relating to the services provided by Helper or payments made by or due from Parent, the Parent and the Helper are responsible for resolving any such disputes directly with each other. ZiiP Care will not be a party to any such dispute, and ZiiP Care will not be obligated to take any action toward resolving the dispute.

 

We are not responsible for any tax withholding or reporting, including Social, Health, Unemployment or Personal Income Tax.

 

ELIGIBILITY

 

By requesting to use, registering to use and/or using the Site, you represent and warrant that:

 

Minimum Age. 

You are an individual at least 16 years of age;

 

Teen Helpers. 

Individuals who are either 16 or 17 years of age may register as a Teen Helper and may use the Site provided that the Teen Helper's parent or legal guardian ("Teen Helper's Parent"):

  1. Provides to ZiiP Care written consent for the Teen Helper to register and use the Site,
  2. Agrees to these Terms of Service and to ZiiP Care's Privacy Policy on his or her own behalf and on behalf of the Teen Helper,
  3. Provides ZiiP Care with such other documentation, acknowledgments, agreements and verifications as ZiiP Care may request. Approval of a Teen Helper's registration shall be at ZiiP Care's sole discretion. Once a Teen Helper turns 18 years of age, the Teen Helper will be required to agree to the Terms of Service in effect at that time, and will, at that time, no longer be considered a Teen Helper under these Terms of Service.

Parents acknowledge that ZiiP Care has no obligation to verify the age of Teen Helpers. Parents who wish to book a Teen Helper should make their own assessments of the Teen Helper's background, qualifications and suitability to provide the requested services.

Criminal History. 

You and each member of your household;

  1. have/has never been convicted of, or is/are currently pending trial for, any felony, any criminal offense involving violence, abuse, neglect, fraud or larceny, or any offense that involves endangering the safety of others;
  2. have/has not been and are/is not currently required to register as a sex offender with any government entity.

 

NOTE to Parents regarding the Identification Verification of Helpers.  

SAIGON HELPER HAS NO OBLIGATION TO CONDUCT BACKGROUND OR VERIFICATION CHECKS ON ITS USERS. 

 

However, to the extent permitted by law, we reserve the right to conduct such checks and/or to verify any account and registration information and the representations and warranties that have made, which may include, without limitation, ZiiP Care using third party service providers to conduct criminal background checks or identity verification checks or to perform other background or verification services, and, using available public records, including information available on online social networks and other online sources, each to the extent permitted by law.

 

Risk Assumption and Precautions. 

 

You assume all risk when using the Site, including, but not limited to, all of the risks associated with any online or offline interaction with others. You agree to take all necessary precautions when meeting other people found through or associated with ZiiP Care.

 

Group Affiliations. 

 

Anyone may have the option to list certain school or local group affiliations as part of their Profile, and ZiiP Care may allow other people into these groups from at any time. Unless expressly stated otherwise, ZiiP Care is not affiliated with any of these listed organizations nor does ZiiP Care verify anyone’s membership with such listed organizations.

 

PROFILE CONTENT, MASSAGING AND REVIEW RULES AND GUIDELINES.

 

As a Member of the Site, you will have the opportunity to create written public content, such as your profiles ("Profiles"), reviews of Helpers ("Reviews"), and send messages to other Members (“Parents” or “Helpers”). You are solely responsible for any content you post on the Site or send to others, and you understand that once posted or sent, cannot always be withdrawn.

 

Content and Communication Restrictions. 

 

You will not post anywhere on the Site or send directly to other Members any content (including links to content) that:

 

  1. Contains photographs or images of another person, unless you are that person's parent or legal guardian;
  2. Contains others' copyrighted content unless you have written permission from the copyright owner;
  3. Contains or discloses or solicits another person's personal information without his or her written permission;
  4. Implies that the content is in any way endorsed or sponsored by ZiiP Care;
  5. Is implicitly or explicitly offensive, such as content that engages in, endorses or promotes racism, bigotry, discrimination, hatred or physical harm of any kind;
  6. Is intended to harass, annoy, threaten or intimidate anyone else using the Site;
  7. Is false, misleading, defamatory, inaccurate, abusive, obscene, profane, sexually oriented, or otherwise objectionable;
  8. Involves the transmission of junk mail, chain letters, or unsolicited mass mailing or spamming, phishing, trolling or other similar activities;
  9. Contains any malware (including but not limited to viruses, time bombs, trojan horses, cancelbots, worms or other harmful, or disruptive codes, components or devices);
  10. Is off-topic, meaningless, or otherwise intended to annoy or interfere with others' use of the Site;
  11. Uses scripts, bots or other automated technology to access and/or update the Site;
  12. Attempts to circumvent ZiiP Care's messaging tools or booking platform, or attempts to avoid applicable ZiiP Care fees;
  13. Otherwise violates any laws or regulations.

 

Content Removal. 

 

We may, but we have no obligation to, monitor content submitted on the Site, including Profiles, Reviews or other Member content. We may remove any such information, and material that in our sole opinion either: 

  1. Violates, or may violate, any applicable law or either the letter or spirit of these Terms of Service;
  2. Might be offensive, illegal or that might violate the rights, harm, or threaten the safety of others;
  3. Is determined to be inappropriate for any other reason at the sole discretion of ZiiP Care.

 

Review and Recommendation Guidelines. 

 

Parents will have the opportunity to provide Reviews and Recommendations about Helpers. Reviews may only be given by Parents who have officially booked a Helper through the Site. Recommendations may be given by any User (e.g., Parents who have previously employed the Helper but not through the Site). Reviews and Recommendations should not include any personal information about a Helper that is not disclosed in the Helper's public Profile (for example, the Review and Recommendations should not include or reference a Helper's address or phone number), should be limited to your firsthand experience (not what you heard from someone else) and should be factually accurate. Reviews should reflect your experience with a Helper for a specific Job. Recommendations (as opposed to Reviews) should reflect your positive experiences with a Helper. Negative content should not be submitted as part of a Recommendation and such content may be removed by ZiiP Care, in our sole discretion. You should avoid broad generalizations and exaggerations. If appropriate, you should update your Reviews and Recommendations to reflect new experiences. As with other content, we reserve the right to remove any Review or Recommendation that we feel, in our sole discretion, violates these guidelines.

We want to provide a positive platform that benefits both Parents and Helpers.

 

THEFT

 

The Parent understands the risk of letting anyone unrelated into their home. While ZiiP Care imposes a strict “no tolerance policy” for theft or other illegal activities during any Job, ZiiP Care is under no obligation to become involved should a Parent accuse a Helper of theft, and would not do so unless there is concrete proof of theft, such as video or admission.  If you believe that something has been stolen from your home or property, we request that you first check if it has been moved or misplaced by accident, as we find this is the most common situation.  However, if something does go missing while a Helper is caring for your children, you may file a report with our Member Support Team. Saigon Helper will put the report on file and should ZiiP Care find any factual evidence to support the claim, ZiiP Care will pass this to the Parent.

 

In order to truly prevent any theft or misplacement, we strongly suggest that you lock up and put away any valuables, such as money, jewelry, phones, etc.

 

CONFIDENTIALITY

 

The Parent agrees to keep in confidence the identity of all Helpers provided by ZiiP Care, and any Helper profiles, recommendations and reviews, or contact information will not be shared to other Parents or outside sources that is not readily public and available on the Site. 

 

We understand that sometimes Parents would like to share a good experience to other Parents and recommend a Helper to them.  Giving the name of the Helper is fine, so that another Parent may search, inquire about or request that Helper through the ZiiP Care Site.  However, any additional Helper personal information is strictly prohibited to protect the rights of the Helper.

 

LIABILITY

 

The Parent understands that ZiiP Care does not employ any Helpers, rather we connect you to a network of Helpers from which you choose.  While ZiiP Care believes everyone benefits and enjoys a better experience from our Helper Resources, such as workshops, training, tips, and activity banks, we are not responsible for the actions of the Helpers while they are caring for your children.

 

The Parent understands the risk of leaving their children in the care of others, and that children can do things that are unexpected even when being carefully watched by the Helper, and the Parent accepts that accidents can happen. Unless children have been physically or mentally abused directly by a Helper the Parent will not take legal action for injuries that may occur by regular activities in which the Helper and children participate, such as; sports, playing on playground equipment, riding bikes, and other Parent approved activities.  Please fill print and fill in our Family Preferences Plan (found in your Resources Bank or Helpful Tips) to ensure that the Helper knows any limitations and expectations for your children, family and household.

 

ACCOUNT TERMINATION

 

You may terminate your account at any time by going to Account Settings and then "Deactivate Account." You may re-register at any time, but your previous information and activity, including any fee credits and any content you may have created, may no longer be available. If you have a Membership, you may cancel it, however refunds are not guaranteed. If you are a Teen Helper, your account may also be terminated by your parent or legal guardian.

 

Effect of Termination. 

 

Upon the termination of your account, you will no longer have access to the portions of the Site and Services that require account registration. If your account is terminated, your Profile will no longer be displayed, but other content you have posted (e.g., Reviews, messages to other Members) may or may not (in ZiiP Care’s sole discretion) remain on the Site. 

Upon the termination of your Paid Membership, you will no longer have access to Paid Services, but you will continue to have access to your account and portions of the Site and Services that are available to Members who do not have Paid Memberships. 

If following the termination or cancellation of your Paid Membership and/or account, you continue to access and use other portions of the Site and/or Services, your use will continue to be governed by these Terms of Service.
